Formcraft

Terms of Service

Last updated October 14, 2026

These terms govern use of Formcraft, operated by Infinity Media LA. Using the service means agreeing to them. If you are agreeing on behalf of a company, you are confirming that you are allowed to bind it.

What the service does

The service lets you build forms, publish them on your own pages, collect submissions, and deliver those submissions to your own systems. It can also request a confirmation code by text message and report completed submissions to advertising platforms you connect.

We may change how the service works. Where a change removes something you rely on, we will give reasonable notice.

Your account

Accounts are issued by invitation. You are responsible for what happens under your account and for the people you invite into it. Tell us promptly if you believe an account has been taken over.

Your information, and your responsibility for it

The submissions your forms collect are yours. We hold and process them on your instructions, and we do not use them for our own purposes beyond running and improving the service.

You decide what your forms ask for and what you then do with the answers, and you are responsible for both. In particular you are responsible for:

  • Publishing a privacy policy that accurately describes what you collect and who you give it to.
  • Having a lawful basis to contact the people who fill in your forms, including consent for calls and text messages where the law requires it.
  • The consent wording on your forms. The service ships standard wording and records exactly what was shown, but whether that wording is sufficient for what you intend to do is a question for your own counsel, not for us.
  • Not collecting payment card numbers, government identifiers, health records or other sensitive categories through the service.
  • Any destination you tell the service to deliver to, including partners and lead buyers.

Calls, texts and consent

Telephone and text message marketing is regulated, including by the Telephone Consumer Protection Act and by state law. The service gives you tools to collect and evidence consent. It does not give you consent, and it does not advise you on whether what you have is enough.

You will not use numbers collected through the service to contact people who have not agreed to be contacted, and you will honor opt out requests promptly.

SMS Messaging Terms

Program description

Formcraft sends text messages for two purposes: a one time code to confirm a phone number entered on a form, and an alert to account holders who have asked to be told when a lead arrives. We do not send marketing messages to numbers collected through forms on this service.

Message frequency

Message frequency varies based on your appointments and interactions with us.

Costs

Message and data rates may apply. Check with your mobile carrier for details about your plan.

Opting out

You can cancel the SMS service at any time. Just text STOP to the number that messaged you. After you send STOP, we will send one final message confirming that you have been unsubscribed, and you will no longer receive messages from us. To rejoin, sign up again as you did originally.

Help

If you experience issues with the messaging program, reply HELP for assistance, or contact us directly at 412-443-0486.

Carrier liability

Carriers are not liable for delayed or undelivered messages.

Connected advertising and calendar accounts

Connecting an advertising or calendar account authorizes the service to act on that account on your behalf, within what you configure. You are responsible for holding the rights to that account and for complying with that platform's own terms.

Acceptable use

You will not use the service to send unsolicited messages, to collect information under false pretenses, to impersonate anyone, to attack or probe the service or anyone else, or to break the law.

We may suspend an account that is doing any of these, and will say why.

Availability

We aim to keep the service running and we do not promise it will never be down. Hosting, databases, text messaging and advertising platforms are provided by third parties, and an outage at one of them is an outage here.

Fees

Where fees apply they are as agreed separately in writing. Costs charged by third parties you connect, such as text message charges, are yours.

Ending it

You can stop using the service at any time. We can end an account for a material breach of these terms that is not fixed within a reasonable time after we point it out. On termination you can export your submissions, and after a reasonable period we will delete them.

Disclaimers and limits

The service is provided as is. To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non infringement.

To the extent the law allows, neither party is liable for indirect, incidental or consequential damages, or for lost profits or lost data, and our total liability is limited to the fees paid for the service in the twelve months before the claim.

Nothing here limits liability for fraud, or for anything else that cannot be limited by law.

Indemnity

You will defend and indemnify us against claims arising from the information you collect through the service, from how you contact the people who filled in your forms, and from your breach of these terms.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict of laws rules, and disputes are heard in the courts located there.

Changes

If these terms change, the date at the top changes with them, and account holders will be told before a material change takes effect.
